Terms of Service

These Terms of Service (the "Terms") govern the use of the Evitalya service (the "Service") provided through the evitalya.com website. By creating an account or purchasing credits you accept these Terms.

This information is provided under Italian Legislative Decree 70/2003 on electronic commerce and Art. 49 of the Italian Consumer Code (Legislative Decree 206/2005).

3. Description of the Service

Evitalya is an urban livability analysis service based on public and institutional data sources. The user enters an Italian address; the system produces a livability score for that address and, on request, a detailed report broken down by category.

5. Purchasing Credits and Prices

  1. You choose a credit package from your account.
  2. Before purchasing you confirm the pre-contractual information and request that performance of the service begin immediately (see section 7).
  3. Payment is completed on the secure payment page operated by Stripe. Accepted method: credit or debit card (including Apple Pay, Google Pay and Link).
  4. Credits are added to your account as soon as the payment is confirmed.
About prices. Amounts are in euro (EUR) and are shown as the total payable on the Stripe payment page before you pay. Because the seller is under the simplified tax regime (regime forfettario), no VAT is shown on the invoice and no VAT is added to the prices. On invoices above EUR 77.47, Italian law requires stamp duty (imposta di bollo) of EUR 2.00; that amount is shown as a separate line on the payment page and is included in the total.

Prices may change at any time; changes do not apply to purchases already completed. Purchased credits do not expire, cannot be transferred and cannot be converted into cash (without prejudice to the refund cases in sections 7 and 15).

6. Invoicing

An invoice is issued for every completed purchase. For customers resident in Italy the invoice is transmitted electronically through the Italian Revenue Agency's Exchange System (SDI); for customers resident abroad the invoice is issued in accordance with the applicable Italian legislation and sent by email on request. You may provide your tax identification number during the purchase.

7. Right of Withdrawal

By confirming the payment you expressly request that performance of the service begin immediately and you acknowledge that you will lose your right of withdrawal as regards the credits used. This acknowledgement is given by ticking a separate box on the purchase screen and is recorded by us.

If you are acting as a consumer, your right of withdrawal in relation to the purchase of credits applies as follows:

To exercise your right of withdrawal it is enough to send an explicit statement to info@evitalya.com (e.g. "I withdraw from my credit purchase of 14 August"). Once we receive your statement we issue the refund within 14 days at the latest, using the same payment method you used and at no additional cost to you.

8. Legal Guarantee of Conformity

The legal guarantee of conformity for digital content and services applies (Art. 135-octies et seq. of the Italian Consumer Code, Legislative Decree 206/2005). If a report does not conform to the contract, you have the right to ask for it to be brought into conformity, for a price reduction, or to terminate the contract. Nothing in this section may be read as limiting or removing those rights.

Evitalya reports are produced from publicly available institutional data sources. The following limits matter:

The Evitalya report and the guide content on the site are for information purposes; they do not replace professional real-estate, environmental, urban-planning, immigration or legal advice. The guide pages on visas, residence permits and university applications are not official sources and are not connected with, or endorsed by, any public authority, consulate, iDATA, VFS Global or university. Always check the official sources before applying. Seek independent professional advice before taking important decisions.

11. Intellectual Property and Third-Party Data

The software, the scoring algorithm, the design and the content are protected by copyright and intellectual property law. Purchasing a report grants you only a personal, non-transferable licence to use the report you bought.

Reports contain content derived from third-party open data sources. The licences and attributions of those sources are listed on the Attributions page; content derived from ODbL-licensed sources (such as OpenStreetMap) is subject to the attribution requirements of that licence.

Prohibited uses: reproducing, redistributing or reselling reports; using the Service for automated scraping or bulk data extraction; reverse-engineering the scoring algorithm (mandatory rules of law are unaffected).

This section covers reports sold to consumers. Scores obtained through the API are licensed differently, under section 21: an active API plan allows you to publish the scores in your own product and in the documents you deliver to your client.

12. Acceptable Use

If these Terms are breached we may suspend or terminate access; section 15 then applies.

13. Service Availability

We work to keep the Service as available as possible, but 100% uptime cannot be guaranteed. The Service may be temporarily unavailable during planned maintenance or events of force majeure. Where a prolonged outage prevents purchased credits from being used, the amount corresponding to the unused credits is refunded.

14. Limitation of Liability

To the maximum extent permitted by law, Evitalya is not liable for:

Evitalya's contractual liability is in any event limited to the amount you paid for the purchase concerned. This limitation does not apply in cases of wilful misconduct, gross negligence, death or personal injury, nor where mandatory consumer law does not permit liability to be limited.

16. Governing Law and Dispute Resolution

These Terms are governed by Italian law. That choice of law does not, however, deprive you of the protection afforded by the mandatory consumer-law provisions of the country of your habitual residence (Art. 6(2) of Regulation (EC) 593/2008, Rome I).

Before taking legal action you can contact us at info@evitalya.com to seek an amicable settlement. We answer complaints within 30 days at the latest.

17. Changes to the Terms

We may amend these Terms. Material changes are notified by email and on the site at least 15 days before they take effect. If you do not accept the changes you may close your account before the effective date; in that case the value of unused credits is refunded. Changes do not apply retroactively to the price of credits already purchased.

18. Commercial Emails (Payment Reminder)

If you open the payment page and leave without completing the transaction, we may send a single reminder email that lets you pick up where you left off. That message is sent under Regulation (EU) 2016/679 and Art. 130 of Italian Legislative Decree 196/2003, and is subject to the following rules:

  1. Every message identifies the sender (name, address, tax number and email address).
  2. Every message contains a one-click unsubscribe link. Your opt-out is recorded immediately and does not expire: we will not send emails of this kind again.
  3. We do not send more than one reminder to the same address within seven days.
  4. This reminder does not affect the transactional emails relating to your purchase: payment confirmation, invoice and the sign-in link to your account are sent to perform the contract and are outside the scope of the opt-out.

21. API: Licence and Permitted Use

This section applies only to scores obtained through the API (/v1/score and related endpoints); reports sold to consumers remain under section 11. For as long as your API plan is active you are granted a non-exclusive, worldwide, non-transferable and non-sublicensable right of use.

If you buy through an authorised channel. Scores obtained through RapidAPI, Apify, Zyla and api.market come from our partner key, not from a plan in your own name: whoever buys through one of those channels has the same rights and the same limits set out in this section, for as long as their subscription or credit with that channel is active. The attribution requirement below applies to them too.

Attribution is required. Every score you publish must carry a visible "Evitalya" credit and a link to evitalya.com. The scores are derived from third-party open data: each source's own attribution terms (ODbL for OpenStreetMap, for instance) are listed on the Attribution page and bind you too.
